1. Acceptance of Terms
By accessing, browsing, or otherwise utilizing the BedTime Stories website (hereinafter referred to as “the Platform,” “our Service,” or “the Website”), located at bestkids.app and bestkidsapp.com, including all associated subdomains, web pages, and web-based functionalities delivered through standard internet browsers, you acknowledge, confirm, and agree that you have read, understood, and consent to be bound by these Terms and Conditions in their entirety. These terms constitute a legally binding agreement between you (“the User,” “you,” or “your”) and BedTime Stories (“we,” “us,” or “our”). Your continued use of the Platform shall be deemed as irrevocable acceptance of these terms as amended from time to time.
2. Scope and Applicability
These Terms and Conditions apply exclusively to the use of the BedTime Stories website as accessed through web browsers on desktop computers, laptops, tablets, and mobile devices via standard HTTP/HTTPS protocols. These terms do not govern, regulate, or otherwise pertain to any native mobile applications (including but not limited to iOS and Android applications) that may be developed, published, or distributed separately. Native mobile applications, if and when made available, shall be governed by their own respective terms of service, end-user license agreements, and applicable platform-specific policies as promulgated by the relevant application distribution platforms.
3. Description of Service
The Platform provides a web-based service that facilitates the presentation, distribution, and consumption of digitally generated narrative content (hereinafter “Stories”) intended primarily for children within specified age demographics. The Service encompasses, without limitation, the rendering of illustrated textual content, the provision of audio narration capabilities, the delivery of multilingual content variants, and such other features and functionalities as may be introduced, modified, suspended, or discontinued at our sole and absolute discretion without prior notice or obligation to any party.
4. User Eligibility and Account Registration
The Platform is intended for use by individuals who have attained the age of majority in their respective jurisdiction or by minors under the direct and active supervision of a parent or legal guardian. By creating an account or utilizing any feature that requires authentication, you represent and warrant that: (a) you possess the legal capacity and authority to enter into this agreement; (b) all information provided during registration is truthful, accurate, current, and complete; (c) you shall maintain and promptly update such information to ensure its continued accuracy; and (d) if you are accessing the Platform on behalf of a minor, you accept full responsibility for such minor's use of the Service and agree to be bound by these terms on their behalf.
5. Intellectual Property Rights
All content presented on the Platform, including but not limited to text, narratives, illustrations, images, audio recordings, graphical elements, user interface designs, visual interfaces, computer code, software, trademarks, service marks, logos, and the overall arrangement and compilation thereof (collectively, “Platform Content”), is the exclusive property of BedTime Stories or its licensors, and is protected by applicable intellectual property laws including copyright, trademark, patent, and trade secret laws. No Platform Content may be copied, reproduced, distributed, republished, downloaded, displayed, posted, transmitted, or otherwise exploited in any form or by any means without the express prior written consent of BedTime Stories, except as expressly permitted by these Terms or as otherwise authorized by applicable law.
6. AI-Generated Content Disclaimer
You acknowledge and understand that certain content delivered through the Platform, including but not limited to story narratives, illustrations, and audio narrations, may be generated, in whole or in part, through the use of artificial intelligence technologies and automated content generation systems. While we endeavor to ensure the appropriateness and quality of such content, we make no representations, warranties, or guarantees regarding the accuracy, completeness, educational value, suitability, or fitness for any particular purpose of AI-generated content. The Platform shall not be held liable for any perceived inaccuracies, inconsistencies, or unintended elements within such content. Parents and guardians are encouraged to exercise their own judgment and discretion when allowing minors to access and consume content delivered through the Platform.
7. Acceptable Use Policy
In connection with your use of the Platform, you agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation; (b) attempt to gain unauthorized access to any portion of the Platform, other accounts, computer systems, or networks connected to the Platform through hacking, password mining, or any other means; (c) use any automated system, including robots, spiders, scrapers, or offline readers, to access the Platform in a manner that sends more request messages to our servers than a human can reasonably produce in the same period using a conventional web browser; (d) interfere with or disrupt the integrity, security, or performance of the Platform or any associated systems; (e) attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of any software underlying the Platform; or (f) engage in any conduct that restricts or inhibits any other user from using or enjoying the Platform.
8. Service Availability and Modifications
We reserve the unconditional right to modify, suspend, discontinue, or restrict access to any or all portions of the Platform at any time, with or without notice, and without liability to you or any third party. We do not guarantee that the Platform will be available at all times or that it will be free from errors, interruptions, viruses, or other harmful components. We may, at our sole discretion, impose limits on certain features or restrict your access to parts or all of the Platform without notice or liability. Scheduled and unscheduled maintenance, updates, and infrastructure changes may result in temporary unavailability of the Service.
9. Limitation of Liability
To the maximum extent permitted by applicable law, BedTime Stories, its affiliates, directors, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, regardless of whether such damages are based on contract, tort, negligence, strict liability, or any other legal theory, and even if BedTime Stories has been advised of the possibility of such damages. In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of, or inability to use, the Platform exceed the amount paid by you, if any, for accessing the Platform during the twelve (12) months immediately preceding the event giving rise to such liability.
10. Indemnification
You agree to indemnify, defend, and hold harmless BedTime Stories and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit, post, or transmit through the Platform.
11. Third-Party Services and Links
The Platform may contain links to, or integrations with, third-party websites, services, or resources that are not owned or controlled by BedTime Stories. We have no control over, and assume no responsibility for, the content, privacy policies, practices, or availability of any third-party websites or services. Your interactions with such third-party services are governed solely by the terms and policies of those third parties. We strongly recommend that you review the terms and privacy policies of any third-party websites or services that you access through or in connection with the Platform.
12. Termination
We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BedTime Stories operates, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be resolved through good faith negotiation between the parties. If such negotiation fails to resolve the dispute within a reasonable period, the parties agree to submit to the exclusive jurisdiction of the competent courts of the applicable jurisdiction.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
15. Amendments
We reserve the right to amend, update, or modify these Terms at any time at our sole discretion. Any changes shall become effective immediately upon posting of the revised Terms on the Platform. Your continued use of the Platform following the posting of revised Terms constitutes your acknowledgment and acceptance of such changes. It is your responsibility to review these Terms periodically for updates. We may, but are not obligated to, notify you of material changes through the Platform or via the email address associated with your account.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BedTime Stories with respect to your use of the Platform and supersede all prior or contemporaneous communications, proposals, and representations, whether oral or written, with respect to the subject matter hereof.
